Terms of Service for Magic Garage Doors

1. Agreement to Terms
These Terms of Service (“Agreement”) constitute a legally binding agreement between you (“Customer,” “you,” or “your”) and Magic Garage Doors, a garage door repair and installation service operating in Jefferson County, Missouri (“Company,” “we,” “us,” or “our”).
By accessing our website (magicgaragedoorsstl.com), requesting a service estimate, scheduling an appointment, or engaging our services in any way, you agree to be bound by these Terms of Service in their entirety. If you do not agree with any provision of this Agreement, you are not authorized to use our website or services.
These Terms of Service apply to all services provided by Magic Garage Doors, whether delivered in person, over the phone, via email, or through our website.
2. Services Provided
Magic Garage Doors provides garage door repair, installation, maintenance, and related services in Jefferson County, Missouri and surrounding areas (“Service Area”).
A. Service Description
Our services include, but are not limited to:
- Emergency and routine garage door repair
- Garage door opener repair and installation
- Spring and cable replacement
- Track and roller service
- New garage door installation
- Maintenance and inspections
- Smart opener installation and configuration
B. Service Estimates
We provide free estimates for most services. Estimates are valid for 30 days from the date provided. Estimates are based on information available at the time of assessment and may be revised if conditions are different than described or if additional issues are discovered during service delivery.
C. Service Availability
Service availability depends on current workload, technician availability, and location within our Service Area. We offer same-day emergency service when possible, but cannot guarantee specific time frames. We will make reasonable efforts to accommodate scheduling requests.
3. Pricing and Payment
A. Pricing
All pricing is provided in the estimate and invoice. Prices are quoted in United States dollars. We reserve the right to adjust pricing if service requirements change or additional work is discovered during service delivery. Any changes to pricing will be communicated to you before proceeding with additional work.
B. Payment Terms
Payment is due in full upon completion of service unless other arrangements have been made in writing. We accept cash, check, credit cards, debit cards, and electronic transfers. A 3% convenience fee applies to credit card payments.
C. Late Payment
If payment is not received within 30 days of invoice date, the account will be considered past due. We reserve the right to pursue collection action, including court proceedings, for unpaid balances. You agree to pay all collection costs, attorney fees, and court costs associated with collection efforts.
D. Deposits
For larger installations or jobs, we may require a deposit to secure your appointment. Deposits are typically 25-50% of the estimated cost. Deposits are non-refundable if the Customer cancels within 48 hours of the scheduled appointment.
4. Cancellation and Rescheduling
A. By Customer
You may cancel an appointment with 48 hours’ notice without penalty. Cancellations made within 48 hours of the scheduled appointment may result in a service call fee of $75-$150, depending on circumstances.
B. By Company
Magic Garage Doors may cancel or reschedule appointments due to:
- Technician illness or emergency
- Severe weather conditions that make service unsafe or impossible
- Lack of required parts or equipment
- Customer property access issues
We will provide as much advance notice as possible and work to reschedule at your earliest convenience.
5. Warranties
A. Service Warranty
All repairs performed by Magic Garage Doors include a 30-day warranty on labor and 1-year warranty on parts, unless otherwise specified in writing.
If a repair fails or needs adjustment within the warranty period, we will correct the problem at no additional charge. Warranty coverage does not include damage caused by misuse, accident, unauthorized repairs, or normal wear and tear.
B. Installation Warranty
New garage door installations include:
- 1-year warranty on installation labor
- Manufacturer’s warranty on doors and openers (varies by manufacturer, typically 3-10 years)
We provide documentation of all manufacturer warranties. Warranty coverage requires normal use and proper maintenance.
C. Warranty Limitations
Warranties do not cover:
- Damage from misuse, abuse, or accident
- Unauthorized repairs or modifications
- Normal wear and tear
- Damage from failure to perform recommended maintenance
- Issues caused by third parties
- Cosmetic damage that does not affect function
D. Warranty Claims
To file a warranty claim, contact us within 30 days of discovering the issue. We will assess the issue and determine if it is covered by warranty. If covered, we will make necessary repairs at no charge.
6. Limitations of Liability
A. No Guarantee of Results
While we use industry-standard practices and quality materials, we cannot guarantee that your garage door system will never require future repairs. Garage doors are mechanical systems subject to wear and may experience issues despite professional service.
B. Liability Cap
To the maximum extent permitted by law, Magic Garage Doors’ total liability arising from or relating to this Agreement, your use of our services, or any breach of these Terms shall not exceed the amount paid for the specific service that gave rise to the claim.
C. Excluded Damages
In no event shall Magic Garage Doors be liable for:
- Indirect, incidental, consequential, special, or punitive damages
- Lost profits, lost revenue, lost business opportunity, or lost data
- Damage to personal property beyond the garage door itself
- Injury or harm resulting from service (except as provided by law)
- Third-party claims
This limitation applies whether liability arises from breach of contract, tort, negligence, strict liability, or any other legal theory.
7. Customer Responsibilities
A. Property Access
The Customer is responsible for ensuring that our technicians have safe, unobstructed access to the garage and garage door. This includes:
- Clearing driveways and garage floors of obstacles
- Removing vehicles if necessary
- Ensuring gates or doors are unlocked
- Informing us of any hazards, pets, or security concerns
If access cannot be provided as scheduled, the appointment may be rescheduled and a service call fee may apply.
B. Accurate Information
You agree to provide accurate information about:
- Your address and directions to your property
- Your garage door’s make, model, and condition
- Any existing damage or problems
- Your preferred appointment time
Failure to provide accurate information may result in scheduling conflicts or service delays.
C. Payment Responsibility
You are responsible for payment in accordance with the pricing and payment terms outlined in this Agreement and in your invoice.
D. Maintenance
To maintain warranty coverage and ensure proper function, you are responsible for:
- Regular lubrication of moving parts (as recommended)
- Visual inspection for wear or damage
- Prompt reporting of issues or unusual sounds
- Not attempting repairs yourself
8. Safety and Liability
A. Inherent Risks
Garage door systems involve mechanical components under significant tension and electrical components. Improper handling or maintenance can result in serious injury or property damage. Our technicians are trained in safe service practices. Customers are advised not to attempt repairs themselves.
B. Assumption of Risk
By engaging our services, you acknowledge the inherent risks of garage door systems and assume responsibility for your safety and the safety of others on your property during service.
C. Insurance
Magic Garage Doors maintains general liability insurance covering our service activities. However, we recommend that homeowners maintain homeowner’s insurance coverage for their garage door systems.
D. Accident Reporting
If any accident, injury, or damage occurs during service, the Customer must report it to Magic Garage Doors immediately. We will document the incident and work with our insurance if necessary.
9. Service Area and Travel
A. Service Area
We service all of Jefferson County, Missouri, including Arnold, Barnhart, Festus, Hillsboro, Imperial, House Springs, Herculaneum, Crystal City, and surrounding areas. Service outside this area may be available upon request with additional travel fees.
B. Travel Charges
For service locations beyond our standard Service Area, travel charges apply. Travel charges will be disclosed in your estimate.
C. Appointment Windows
We schedule appointments in general time windows (e.g., “morning,” “afternoon”). We make reasonable efforts to arrive on time, but cannot guarantee specific arrival times due to traffic, weather, and other variables. We will keep you updated if we are running significantly late.
10. Prohibited Activities
When using our website or engaging our services, you agree not to:
- Provide false or misleading information
- Engage in abusive, threatening, or harassing behavior toward our staff
- Damage or vandalize our equipment or vehicles
- Interfere with or obstruct our service activities
- Use our services for illegal purposes
- Violate any applicable laws or regulations
Violation of these prohibitions may result in termination of service and loss of any service warranties.
11. Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of Magic Garage Doors or our content providers and is protected by copyright and other intellectual property laws.
You may view and print content for personal, non-commercial use only. You may not:
- Reproduce, modify, or distribute content
- Reverse engineer or decompile any software
- Remove or alter any copyright or proprietary notices
- Use our content for commercial purposes without written permission
12. Third-Party Links and Content

13. Limitation of Warranties

EXCEPT AS EXPRESSLY PROVIDED IN SECTION 5 (WARRANTIES), MAGIC GARAGE DOORS PROVIDES SERVICES ON AN “AS-IS” AND “AS-AVAILABLE” BASIS WITHOUT ANY OTHER WARRANTIES, EXPRESS OR IMPLIED.
WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
14. Indemnification
You agree to defend, indemnify, and hold harmless Magic Garage Doors, its owners, employees, agents, and representatives from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from or related to:

- Your breach of this Agreement
- Your violation of any applicable laws
- Your negligence or misconduct

15. Dispute Resolution
A. Informal Resolution
Before pursuing formal legal action, you agree to contact Magic Garage Doors to attempt to resolve disputes informally. Contact us within 30 days of discovering the issue.
B. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to conflict of law principles.
C. Jurisdiction and Venue
You agree that any legal action or proceeding arising from this Agreement shall be brought exclusively in the state or federal courts located in Jefferson County, Missouri. You consent to the jurisdiction and venue of these courts.
D. Class Action Waiver
You agree not to participate in class action lawsuits or class-wide arbitration against Magic Garage Doors. All claims must be pursued individually.
16. Entire Agreement and Modification
A. Entire Agreement
This Terms of Service, together with our Privacy Policy and any written service agreement, constitutes the entire agreement between you and Magic Garage Doors regarding our services and supersedes all prior negotiations, understandings, and agreements.
B. Modification
Magic Garage Doors reserves the right to modify these Terms of Service at any time. Modifications will be effective upon posting to our website. Your continued use of our website or services following such modifications constitutes acceptance of the updated Terms.
C. Severability
If any provision of this Agreement is found to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
17. Termination
A. Termination by Company
We reserve the right to terminate or suspend services to any Customer who:
- Fails to pay for services as required
- Engages in abusive or harassing behavior
- Violates these Terms of Service
- Creates unsafe conditions for our staff
B. Termination by Customer
You may terminate an ongoing service relationship by providing written notice. Any outstanding balances remain due.

19. Severability and Construction
